This is the privacy statement ("Statement") that governs how Newmont Corporation and its affiliated companies ("Newmont," "we," "us," or "our"), uses personal data (defined below) that is processed (also defined below) in connection with your ("user," "you," or "your") interaction with us and how we comply with our data protection obligations under the various laws, rules, and regulations to which we are subject as a global company.

Please read this Statement carefully to better understand how we collect, use, store and disclose ("Process", "Processed", "Processing") your personal data when you engage with us. This statement addresses how we handle the personal data we process when you engage with us for any reason unrelated to Human Resources. Generally, these categories include (but are not limited to): use of our website https://www.newmont.com or any of the other websites or applications we operate that link to this Statement (collectively our "Sites"), and any business engagement, stakeholder communication, security and safety interaction and community engagement (collectively the "Interaction"). Introduction.

We are committed to respecting privacy and recognize the need for appropriate protection and management of any personal data that is processed by us as part of an interaction. As used in this Statement, "Personal Data" means any information, either alone or in combination with other information, which relates to an identified or identifiable natural person, which may include "Health Information" and "Special Category Information", defined below. We collect your personal data directly or indirectly through document(s) that you upload to the Site or through a third party, as discussed more fully in Section 3 below.

In some instances, you may choose whether or not to provide/disclose your personal data in connection with your interaction with us. If you choose not to provide the personal data we request, you will still be able to visit and use parts of our Sites, but you will not be able to access or use certain features, views, programs, products and services. Due to security concerns, your refusal to provide personal data may also prohibit you from accessing our physical locations (including, but not limited to, our operating sites) and may adversely affect our ability to do business with you or the organization you represent.

Our sites may contain links to third-party sites featuring products, services and advertisements that Newmont does not own or control. We are not responsible for the privacy practices or the content of such third-party sites, products, services and advertisements, and you visit them at your own risk.

This Statement applies to, but is not limited to, personal data of the following persons:

  • Visitors to our Sites;
  • Visitors to our operating Sites and other physical locations;
  • Representatives of our past, current and prospective customers;
  • Representatives of our business partners, Local and past, current and prospective contractors;
  • Our shareholders and/or their representatives; and
  • Representatives of our joint venture partners and other stakeholders.

 

2. Categories of personal data which we may collect

Our interactions with you may require us to process certain information, which may contain personal data about you. This includes but is not limited to:

  • Personal and business demographic information, such as name, address, date of birth, citizenship status and similar information;
  • Information related to your professional qualifications, education and training;
  • Information related to your travel plans if you are visiting our operational Sites;
  • Information related to shareholder tax and accounting issues, including tax and withholding calculations, bank information (for payment purposes) and taxpayer identification numbers;
  • Information related to workplace safety, including training, accident and incident reports and investigation, first aid and other medical records, medical or other information related to workers' compensation claims, and medical records related to hazardous exposure monitoring;
  • Information collected via machinery or equipment you operate while on the Site at our physical locations; and
  • Biometric data such as photographs, fingerprints and iris scans used for security credential issuance or operator security monitoring.

In certain circumstances, Newmont may process personal data which includes information relating to your medical or health history ("Health Information"), or other information relating to your race or ethnicity, political, philosophical or religious beliefs or affiliations, political, trade or professional associations, trade union memberships, sexual preferences or practices, or criminal records (collectively, with Health Information, "Special Category Information"). Newmont will not collect or process Special Category Information unless it is necessary to do so and, if we have your consent or other lawful basis to do so under applicable data privacy laws. We may process health information for:

  • Provide medical assistance and treatment in the event of a medical emergency, and
  • To otherwise comply with our health and safety obligations (including, but not limited to, our operating Sites), or as otherwise required or permitted by applicable law.

 

3. Information processed by newmont.

Newmont processes certain information that may constitute personal data in the following ways:

(a) Newmont's business and operations.

Newmont may collect a range of personal data related to its business and operations, including, but not limited to, your name, age, gender, job title, photo ID, email address, home or office address, telephone number, information contained within communications with you (including meeting notes and recorded phone calls), feedback or survey responses, and financial and payment information. If you are visiting our operating sites, we may also ask you to provide us with your health information. If you provide us with personal data relating to another person, you must ensure that they have agreed to disclose this or that it is otherwise lawful under applicable data privacy laws.

(b) Personal data collected by third parties.

We may use certain third party services Local to perform certain operations of our business. These Local may collect personal data about you in performing their services and/or functions on our behalf. For more information regarding our Local services, their business purposes and their privacy practices, please review Section 5 of this Statement.

(c) Information collected automatically via our Sites.

We automatically collect certain information on our Sites through various software tools. Information collected automatically includes:

  • Log files.
    The information within the log files includes internet protocol ("IP") addresses, browser type, internet service provider ("ISP"), date and time stamp, referring/exit pages, pages accessed and any other information your browser may send us.
  • Cookies.
    Our sites use cookies. A cookie is a small text file that is placed on your computer or mobile device when you visit a site or use an application. Cookies collect information about users and their visits to the website or use of the application, such as internet protocol (IP) addresses, how they arrived at the website (for example through a search engine or a link from another website) and how they navigate within the website or application. We use cookies and other technologies to facilitate your Internet sessions and use of our sites, track the use of our sites and compile statistics about activities on our sites. You can set your browser to block or delete cookies stored on your computer or mobile device. However, if you do so, you may not be able to use certain features and functions of our site. Most modern browsers allow you to change your cookie settings. Generally, you can find these settings in the preferences or options menu of your browser.
  • Do Not Track signals.
    Newmont does not track users over time or across third party websites to provide targeted advertising. Likewise, we do not currently respond or take any action with respect to "do not track" or other mechanisms that provide customers the ability to exercise choices regarding the collection of personal data about a person's online activities over time and across third-party websites or online services.
  • Analytics Services.
    We may use certain third-party analytics services to improve the functionality, features or delivery of our sites. We may also use these analytics services to record mouse clicks, mouse movements, browsing activities, as well as any text you type on our sites. For example, we use Google Analytics on our websites to track user trends and usage. For more information about Google Analytics' processing of personal information and how it relates to our sites, please visit http://www.google.com/policies/privacy/partners/. By using a browser plug-in provided by Google (available at http://www.google.com/ads/preferences/plugin/), you may opt out of Google Analytics.
  • Other tracking technologies.
    When you visit our sites, we may collect your IP address for certain purposes such as, for example, monitoring the regions from which you browse our Site. We may also use web beacons/web beacons alone or in conjunction with cookies to gather information about your use of our sites and interaction with our emails. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you browse a particular website linked to the web beacon. We may use web beacons to operate and improve our sites.

 

4. The purposes for which we collect and use personal data.

If you provide, or we collect, personal data, then such personal data may be used to:

  • Managing and operating our business, including negotiating contracts, managing business relationships with the entity you represent or work for, administering real estate contracts and licenses, managing accounts and records, facilitating payments for goods and services, managing a CRM database, maintaining records and audit information related to our customers and contacts, communicating with you and other third party contacts, facilitating planned exports in compliance with export control laws and in support of corporate social responsibility activities;
  • Manage our operating sites, including compliance with health and safety requirements;
  • Manage and administer our relationships with shareholders;
  • To provide, analyze, administer, improve and customize our Sites;
  • Contact you in connection with events, programs or offers for which you may have registered;
  • Send your updates and marketing materials;
  • Identify and authenticate your access to the portions of the Sites to which you have authorized access;
  • Manage our Sites and internal operations, including data analysis and testing;
  • Ensure the technical functionality and security of the Sites;
  • Conducting internal investigations and audits, and
  • Perform and comply with our legal and regulatory obligations.

Newmont limits the processing of personal data to what is necessary for the intended purposes for which it was collected or authorized by the data subject and takes reasonable steps to ensure that all personal data is reliable, accurate, complete and current. Newmont processes personal data in accordance with applicable laws including, without limitation and to the extent relevant, the European Union General Data Protection Regulation ("GDPR"), the Australian Privacy Principles set out in the Australian Privacy Act 1988 ("Australian Privacy Laws") and U.S. federal and state laws (collectively "Applicable Data Privacy Laws"). To the extent relevant under applicable Data Privacy Laws, Newmont processes personal data under various legal bases, including legitimate business interests, the need to perform a contract, consent, and compliance with Newmont's legal and regulatory obligations.

5. How We Disclose Personal Information.

We do not sell, rent or otherwise disclose your personal data to third parties except as otherwise stated below or with your consent. We may disclose your personal data in the following circumstances:

(a) To our Local third parties.

We transfer personal data to our third party service providers Local to perform certain tasks on our behalf. For example, we share your personal data with Local services who support us in processing invoices or to route an inquiry you have submitted to the relevant department within Newmont. We also use third parties for technical support of our Sites, application development, tracking and reporting functions, quality assurance and other services. These entities are required to protect the confidentiality of this personal data and are prohibited from using it for any purpose other than as set forth in this Statement.

(b) To our subsidiaries and joint venture partners.

We may share your personal data with our affiliates and joint venture partners in connection with our business and operational purposes. These entities are required to protect the confidentiality of this personal data and are prohibited from using it for any purpose other than as set forth in this Statement.

(c) In the event of a merger, sale, or change of control.

We may transfer or assign this Statement and any personal data to third parties who acquire or merge with us (or who seek to acquire or merge with us) as part of a merger, acquisition, sale or other change of control or who otherwise acquire (or seek to acquire) all or substantially all of our assets.

(d) Aggregate information.

We may conduct research on user demographics, interests and behaviors based on personal data and other information provided to us. This research may be compiled and analyzed on an aggregate basis and we may share this aggregate information with our affiliates, agents and business partners. This aggregate information does not identify a user personally. We will also disclose the information to our business partners and other current and prospective third parties for other lawful purposes.

(e) Other disclosures.

We may disclose personal data about you if you believe that disclosing this information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request, (ii) enforce our Terms of Use at https://www.newmont.com/legal/ including investigations of potential violations, (iii) detect, prevent or otherwise address fraud or security issues and, (iv) protect against harm to the rights, property or safety of Newmont or its affiliates and joint venture partners, our users or the public.

6. Retention, Rectification, Destruction and Non-Identification of Personal Data.

Newmont will take reasonable steps to ensure that your personal data maintained is accurate, complete, and up to date. We will update personal data promptly if it is determined that such personal data has changed or is inaccurate.

We will retain any personal data as long as such data is necessary to: (i) fulfill the purposes described in this Statement or, (ii) comply with applicable laws.

7. Unsolicited Personal Data

If we receive any unsolicited personal data that is not required for the purpose described in Section 5 of this Statement, we will (if lawful and reasonable to do so) destroy the information or ensure that the information is de-identifiable as soon as practicable.

8. Data Security.

The privacy and security of personal data is very important to us. Taking into account the nature, scope, context and purposes of personal data processing, as well as the risks of varying likelihood and severity to the rights and freedoms of natural persons, Newmont has implemented appropriate technical and organizational measures to ensure and enable us to demonstrate that its processing of personal data is carried out in accordance with applicable data privacy laws. However, no method of transmission over the Internet, or method of electronic storage is 100% secure. Accordingly, while we strive to use commercially acceptable means to protect personal data, we cannot guarantee its absolute security. We report known security incidents to both regulators and affected individuals in accordance with applicable data privacy laws.

9. Privacy of Minors.

Our Sites and business operations are not directed to children and persons under the age of 18.

10. E-mail Communications.

You may choose not to receive future emails from us by selecting the unsubscribe link at the bottom of each email you receive from us. Please note that even if you opt out of receiving emails, we may still send you a response to any "Contact Us" requests as well as administrative, maintenance and operational emails (for example, in connection with a password reset request). 11. Your California Privacy Rights.

If you reside in California, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of personal data about you from Newmont to third parties for third party direct marketing purposes. 12. International Transfer.

Newmont is an international company with subsidiaries located in several countries. Our Sites and databases are currently located on servers in the United States and other countries, and we cooperate with various third party processors in countries around the world including, but not limited to, our operating sites in Argentina, Australia, Canada, Dominican Republic, Ghana, Peru and Suriname. In addition, Newmont may transfer personal data that we collect to third parties in countries other than the country where the personal data was initially collected. These countries may not have the same data protection laws that apply to the data subject or where the personal data was originally collected. When we transfer personal data that is received in other countries, we will protect it as described in this Statement.

13. Individual Rights.

Depending on where you reside, you may have the right to file a complaint with a supervisory authority or other regulatory agency if you believe that we have violated any of your rights related to your personal data. We encourage you to contact us first at privacy.officer@newmont.com, so that we have the opportunity to address your concerns directly before you do so.

Newmont will cooperate with the relevant data protection authorities for the purpose of handling any unresolved complaints regarding your personal data concern. Staff may involve the local personal data protection authority, and Newmont will respond directly to such authorities regarding the investigation and resolution of complaints.

2. Categories Of Personal Data We May Collect.

Our employment relationships with you may require us to process certain information, which may contain personal data about you. This includes but is not limited to:

  • Information directly related to your employment, such as position and title, rate of pay, promotions, transfers, performance reviews and other employment actions;

  • Information related to workplace safety, including training, accident and incident reports and investigation, first aid and other medical records, medical or other information related to workers' compensation claims, and medical records related to hazardous exposure monitoring;
  • Information collected via machinery or equipment you operate while at our physical locations;
  • Where permitted by applicable law, information on drug and alcohol testing related to the use of prohibited substances; and
  • Biometric data such as photographs, fingerprints and iris scans used for security credential issuance or operator security monitoring.

 

In some cases, the information we process about you may constitute "Sensitive Personal Data", such as information about your racial or ethnic origin, gender, health, political opinions, philosophical or religious beliefs or affiliations, political affiliations, trade union membership, sexual orientation or criminal records. We only process sensitive personal data if we have your consent or if we have other grounds or legal requirements to do so.

3. Information Processed By Newmont.

Newmont processes certain information that may constitute personal data when:

  • you interact with us by sending us e-mails or other correspondence;
  • you complete and submit an online form;
  • you are applying for a job with us;
  • we hired him as an employee;

  • Evaluate your employment application to verify your identity, conduct background checks as permitted by applicable law and, consider and contact you in connection with your employment application and/or other positions and to manage our relationship with you;
  • Evaluate other employment opportunities which may arise from time to time, within our organization or with our joint venture partners;
  • Prevent, detect, investigate and prosecute fraud and other activities that violate our internal policies, standards and procedures or applicable law;
  • Conduct research and statistical analysis with the objective of improving its operations;
  • Provide you with, or obtain for you, medical services in the event that you are injured or become ill while on site at one of our facilities; and
  • Comply with our legal rights and obligations.

 

If you are a contractor, director, officer, employee, subcontractor, agent or representative of a contractor engaged with us, we may collect, use and disclose your personal data to comply with and demonstrate compliance with applicable law, for the performance of a contract and for compliance with our policies, including our policies governing your access to and presence on our operating sites.

Newmont will update personal data promptly if it determines that such personal data has changed or is inaccurate. Newmont limits the processing of personal data to what is necessary for the intended purposes for which it was collected or authorized by the data subject and takes reasonable steps to ensure that all personal data is reliable, accurate, complete and current. Newmont maintains personal data only as long as necessary to fulfill the intended purpose for which it was collected or authorized or as otherwise required by applicable law or regulation including, but without limitation and to the extent relevant, the European Union General Data Protection Regulation ("GDPR"), the Australian Privacy Principles outlined in the Australian Privacy Act 1988 ("Australian Privacy Laws") and U.S. federal and state laws (collectively "Applicable Data Privacy Laws").

5. How We Disclose Personal Information.

In addition to the reasons otherwise stated herein, we may, as necessary and permitted by applicable data privacy Laws, also share your personal data with our:

  • Local external physicians;
  • Local alcohol and drug testing (as permitted by applicable law);
  • external license administrators;
  • joint venture partners;
  • academic institutions, recruiters, professional bodies and organizations, Local security review (as permitted by applicable law), legal counsel, Local professional services (such as accounting firms), joint venture partners and mediators;
  • business associations (as HIPAA defines the term); and
  • government agencies, law enforcement bodies, courts and dispute resolution schemes.

 

We will also disclose personal data to companies that perform services (each, a "Service Provider") on our behalf (e.g., technical infrastructure support or administrative services). Our Local service providers are obligated to use the personal data we share with them only for the purpose for which we provide it to them. In particular, we require our Local service providers to take appropriate measures to protect the confidentiality, integrity and security of your personal data and to comply with applicable laws.

We may transfer or assign this Statement and any personal data to a third party that acquires or merges with us as part of a merger, acquisition, sale or other change of control (such as an internal reorganization of Newmont or our affiliated companies or as a result of a bankruptcy proceeding), or otherwise acquires all or substantially all of our assets.

We may also be required to disclose your personal data to:

  • Comply with applicable laws, regulatory requirements, court orders or subpoenas.
  • To comply with public order or governmental investigations.

6. Health Information.

In certain circumstances, Newmont may process personal data, including information relating to your health or disability ("Health Information"). Newmont will not process Health Information unless it is necessary to do so and we have your consent or have other reasonable legal grounds or needs to do so. We may process Health Information to:

  • provide medical assistance and treatment in the event of a medical emergency;
  • assess their aptitude to work;
  • evaluate compliance with relevant alcohol and drug testing procedures or policies;
  • assess eligibility for licensing programs; and
  • otherwise comply with our health and safety obligations or as otherwise required by applicable law.

 

Any health information that is part of protected health information under the U.S. Health Insurance Portability and Accountability Act ("HIPAA") will also be protected in accordance with Newmont's HIPAA Notice of Privacy Practices.

Newmont will cooperate with the relevant data protection authorities for the purpose of handling any unresolved complaints regarding your personal data concern. Staff may involve the local personal data protection authority, and Newmont will respond directly to such authorities regarding the investigation and resolution of complaints.

8. Data Security.

Newmont takes the security of personal data related to human resources seriously. Newmont has procedures and internal controls in place to protect personal data against loss, accidental destruction, misuse, or disclosure and to ensure that the data cannot be accessed except by associates in the proper performance of their duties. This includes limiting access only to Human Resources, Health and Safety, and Legal personnel. Where Newmont engages third parties to process personal data on its behalf, those parties do so on the basis of documented instructions, are under a duty of confidentiality, and are obligated to implement appropriate measures to ensure the protection of personal data. We report known security incidents to both parties, regulators and affected individuals in accordance with applicable data privacy laws.

9. International Transfer.

Newmont is an international company with subsidiaries located in several countries. Our Sites, servers and databases are currently located on servers in the United States and other countries, and we cooperate with various third party processors in countries around the world including, but not limited to, our operating sites in Australia, Argentina, Canada, Dominican Republic, Ghana, Peru and Suriname. In addition, Newmont may transfer personal data to third parties in countries other than the country where the personal data was initially collected. These countries may not have the same protection laws as those in the countries where the personal data was originally collected. When we transfer personal data that is received in other countries, we will protect it as described in this Statement.
